  1. I'm not quite sure if it is kosher to be selling midibox stuff without permission.

  3. Er, that's my PCB design. That is, the MIDIbox SID-NUXX... I'm not sure who this is, but the board design was licensed as non-commercial, so it is not supposed to be sold.

I'm trying to contact the seller, but if any of them know who it is, could you please contact me at nuxx.net?

    Thanks...

  4. Hi Steve,
I thought it looked like the nuxx design, that is why I made that initial post about it not being OK to sell without permission. I don't know why some people don't understand that you can't sell designs of other people without permission. I guess that is what ebay has come to though. Good luck contacting him.

  5. Come on matrix, are you really going to help guys like this advertise items that are not legally allowed to be sold? I mean, everyone knows that the midibox designs are DIY open source projects and NOT for profit. The midibox community DOES NOT look kindly on people like this.

  6. I put the post up for the pics, if steve wants me to remove the auction link, I'll do it. As for selling for profit, it's not clear to me if this person is. He could be or he could have just built it, played with it a bit and is done with it. I took a look at his other auctions and I see a SoundLab, that's it. I haven't seen this particular SID before otherwise I would have posted it for the shots then. Regardless, I don't really care about the auction link, I just put them up as a courtesy and a note to the source of the shots. If steve wants the link down, I'll take it down. No problemo.

  7. Does selling one's own unit constitute commercial?

  8. "...items that are not legally allowed to be sold?" If you own something, you can sell it. I hear you on the spirit of the Midibox agreement, but unless the guy can be shown to be mass-producing them, he's fine.

  9. Matrix,

Naw, it's fine. I'm going to file the paperwork with eBay tomorrow to try and get the auction pulled for IP violation unless the seller contacts me first. It's interesting to note that the auction doesn't say "MIDIbox" anywhere in it, just my older name for the redesign, "SIDbox". I don't mind you posting it at all, in fact, that's how I found out about it, so I appreciate it.

    To Everyone Else,

The software used for the PCB design was purchased under a non-profit license, and I thusly licensed the board as Creative Commons, Attribution, Non-Commercial, Share-Alike. Therefore the boards cannot be sold commercially. As this is an open market with an uncapped price, I consider this a commercial sale. If the seller was doing some sort of group buy and selling the board at his cost then I'd welcome it and offer whatever support I could. However, as things stand it seems to me to be a commercial sale and in violation of the license of the board's design.

  10. I asked a lawyer about it, and he said because it was his property, he is allowed to sell off what he owned. He mentioned for example, if he passed away and the state take over the property, they are allowed to auction it off also.

  11. if the selling-price is only the cost of the overhead for the hours of work and the material (building and designing the wooden box with acrylic glass, special buttons + connectors etc) - I'm convinced it's allowed to sell it (at least in germany). benny
